If you disagree with a decision made by the Department of Veterans Affairs (VA) (a rating decision) regarding your benefits, you can appeal the decision directly to the Board of Veterans‘ Appeals (BVA). Here’s a simplified guide to the process:
File VA Form 10182 within a year of the denial. This is the official form to request a Board Appeal.
On the form, make sure to list the issues you disagree with and choose Your Appeal Type:
When filing VA Form 10182, you’ll select one of three appeal options:
Direct Review: The BVA will review your case file and make a decision based on the existing evidence at the time of the rating decision.
Evidence Submission: You can submit new evidence to support your claim within 90-days, and the BVA will then review your case including the new evidence you submitted.
Hearing: You can request a hearing before a Veterans Law Judge. This allows you to present your case and have the opportunity provide the judge with more information about your case. You’ll then have additional 90-days to submit more evidence.
